⚠️ IMPORTANT – NOT FOR NAVIGATION
Chart Gap is not an official nautical chart and must not be used for navigation.
- Our maps, depths, contours and 3D views are processed from research surveys and open datasets. No hydrographic office has produced, checked or approved them, and they do not meet SOLAS, IHO or ECDIS requirements.
- The data can be old, incomplete, wrongly positioned or wrong. Depths are not reduced to chart datum unless we say so.
- Blank or "uncharted" areas mean we have no data, not that the water is safe. Surveyed areas can still hide rocks and shoals.
- The GPS / boat view is a convenience display only.
- Always use official charts, notices to mariners, a proper lookout and prudent seamanship. The master remains responsible for the safety of the vessel and everyone on board.
1. These Terms
1.1 These Terms are an agreement between you and OSIBOT PTY LTD for the use of Chart Gap at chartgap.org, including the map viewer, exports and accounts (the "Service"). You accept them when you create an account or use the Service.
1.2 If you use the Service for an organisation, you confirm you may accept these Terms for it.
1.3 Your consumer rights. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Every limit below applies only as far as the law allows.
2. Your account
2.1 You must be 18 or older. You can sign up with an email address and password, or with Google.
2.2 An account is for one person. Keep your login secure, do not share it, and tell us straight away if you think someone else has used it.
3. Plans and prices
3.1 We offer a Free plan (a limited free area), paid Pro (view all paid areas) and Expedition (Pro plus exports) plans, and an invitation-only, free Researcher plan for non-commercial research. Current features and limits are shown on the plans page and at checkout, and form part of these Terms.
3.2 Prices are in US dollars (USD) and are shown before you pay. We are registered for GST, and GST is added for Australian customers where it applies. [ADAM TO CONFIRM: whether shown USD prices include GST for Australian customers]
3.3 We may change or withdraw the Free plan, and add, change or remove areas, layers and features. Coverage is limited and uneven.
3.4 Some links to Chart Gap are affiliate links: the affiliate may earn account credit if you subscribe. This does not change your price.
4. Subscriptions, cancellation and refunds
4.1 Payments are processed by Stripe. We never receive or store your full card number.
4.2 Renewal. Paid plans are billed in advance, monthly or yearly, and renew automatically until you cancel. We will remind you by email before a yearly plan renews.
4.3 Price changes apply only from your next renewal, and we will email you at least [ADAM TO CONFIRM: 30] days before.
4.4 Cancelling. You can cancel at any time from your account page. You keep paid access until the end of the period you have paid for, then your account moves to the Free plan.
4.5 Refunds. [ADAM TO CONFIRM: change-of-mind refunds, e.g. none, or a full refund within 14 days of the first payment.] Otherwise we do not refund partly used periods, except as below or as the law requires.
4.6 Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with the service, you are entitled to cancel your service contract and obtain a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.
4.7 If we stop the Service, or remove a substantial part of your paid plan, during a period you have paid for, we will refund the unused part.
5. Exports and research-only data
5.1 Exports are available on the Expedition and Researcher plans, within the monthly limit shown for your plan.
5.2 You may use exported files within your own organisation for your plan's purposes. You must not sell, publish, share or redistribute them (or data derived from them) outside your organisation, or remove their credits or NOT FOR NAVIGATION notices. [ADAM TO CONFIRM: whether showing exported maps to passengers or guests is allowed]
5.3 Researcher accounts may also see research-only data, whose licence does not yet clearly allow commercial use. It may be used only for the approved non-commercial research, and we may withdraw it at any time.
6. Data licences and credits
6.1 Chart Gap is built from third-party open data. Each source and its licence is listed on our credits page, in the map's Credits panel and in export files. You must keep those credits when you show or share anything from Chart Gap.
6.2 Data providers do not endorse us and are not responsible for our processing. Nothing in these Terms limits your rights under an open licence to the original data obtained from its publisher.
6.3 The Service, our processed grids, tiles, styling and software belong to us or our licensors. We give you a limited, non-transferable right to use them under these Terms.
7. Acceptable use
You must not:
- scrape, bulk-download or systematically copy maps, tiles or data, or use bots, except through an API we provide to you;
- resell or share the Service, your account or download links;
- get around plan, area, export or research-only limits or other security measures;
- remove credits, licence notices or NOT FOR NAVIGATION warnings;
- use the Service unlawfully, or in a way that harms it or other people.
8. Reports and feedback
The Report button lets you tell us about a possible data problem. We read reports but do not promise to reply or fix anything, and it is not a safety reporting service. Report real hazards to the relevant hydrographic office. You let us use your reports and feedback to improve the Service.
9. Accuracy and availability
Apart from your rights under the Australian Consumer Law, the Service and all data are provided "as is". We do not promise that the data is accurate, complete or current, or that the Service will always be available, especially over slow connections at sea.
10. Liability
10.1 Nothing in this section limits your consumer guarantees or any liability that cannot lawfully be limited.
10.2 To the extent the law allows:
- we are not liable for any loss arising from use of the Service or its data for navigation;
- we are not liable for indirect or consequential loss, or loss of profit, revenue, data or opportunity;
- where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to meet a consumer guarantee is limited to supplying the services again or paying for them to be supplied again;
- our total liability is limited to the fees you paid us in the 12 months before the claim, or USD [ADAM TO CONFIRM: 100] if you paid nothing.
10.3 Our liability is reduced to the extent you or someone else caused the loss.
11. Suspension and closing your account
11.1 You can stop using the Service at any time and ask us to close your account.
11.2 We may suspend or close an account for a serious breach of these Terms, for non-payment, or for legal or security reasons. Where reasonable we will warn you first. If we close your account for any other reason, section 4.7 applies.
12. Changes to these Terms
We may update these Terms. The version and date at the top show the current version. We will email you about material changes before they apply, and a change that is worse for you applies to a paid plan from your next renewal. If you do not agree, you can cancel before the change applies.
13. Law and complaints
13.1 These Terms are governed by the law of Queensland, Australia, and the courts of Queensland have non-exclusive jurisdiction. If you are a consumer outside Australia, you keep the mandatory protections of your own country's law.
13.2 If you have a complaint, please contact us first and we will try to resolve it in good faith.
13.3 If we provide these Terms in another language, the English version applies.
